The TTAB recently refused registration of the mark ‘JPK Paris 75’ for sunglasses, handbags and purses, wallets, travel bags, suitcases, belts and shoes because, although the designer is Parisian and spent some 23 years in Paris, the designer and the goods themselves now hail from Miami. Thus, the TTAB found the mark to be “geographically deceptively misdescriptive” of the fashion accessories. Full decision here. Especially persuasive for the refusal in this case was the fact that Paris is a well-known center of design and fashion. So, if you want to use Paris to help brand and sell your wares, you better make sure the connection to Paris is strong.
